| 滥觞于科技革命的证据法上的变革,正引领人们全面开启高精尖的科技证据时代。缘于自身的高证明力却囿于可反驳性阙如的属性,高科技证据在控辩双方的证据链条中有极强的内外稀释效应,并进而产生证明上的“一有俱有,一无俱无”的现象。参酌高科技证据的潜在的、爆发力极强的固有风险,应引入风险系数进行相应修正。 |

| Abstract: |
| The change of evidence law originated from scientific and technological revolution, is leading us to comprehensively open the age of the sophisticated technology. Owing to its high probative force but confined to the property of the lack of refuting itself, the hightech evidence in two parties evidence chain has a strong dilution effect both inside and outside, and thus has proved the phenomenon that "one with all there is, one without all no". Check it by considering the hightech evidence 's potential and highly explosive risk, and advocating the introduction of risking amendments. |
