| 划定作为刑法中业务行为的医疗行为的范围,最根本的是判定是否具有侵害人身的危险性。“保护的优越利益”学说是医疗行为正当化的根据。医疗行为的正当化要件包括:行为人必须具有相应的专业知识和技能;行为具有必要性与合乎水准性、遵守规则性;行为人履行必要的说明义务;行为相对人作出有关承诺。 |

| Abstract: |
| In order to delineate the scope of medical behaviors which can be treated as business conducts in criminal law, the most fundamental work is the ability to determine whether there exits the risk of physical abuse. The theory "superior interests protected" is the basis of its justification. The elements of its justification include:the perpetrator must have the appropriate professional knowledge and skills; the behavior is indispensable in line with standards and abides by the rules; the perpetrator performs the necessary obligation of explanation; behavior relative makes a commitment in response. |
