| 中国目前能够行使逮捕决定权的主体是检察院和法院,但在司法职权的配置中并未有集中或分别设置制约机制,缺乏对检察院、法院两机关逮捕决定权的制约和监督,影响了公民基本人权的司法性保障。逮捕决定权的行使涉及报请批捕、决定逮捕和捕后未决羁押三个阶段,据此分别设计制约机制,有助于实现逮捕决定权机制的完整性,统一检察院和法院在不同阶段的制约要求,增强司法应用的可操作性。 |

| Abstract: |
| The subject that is able to exercise the arrest decision power in our country is procuratorate and court, but in the judicial functions and powers there is no configuration of concentrated or separate restriction mechanism, lack of restriction and supervision for the procuratorate and court in arrest decision power, influencing judicial security of citizens basic human rights. To exercise the arrest decision power involves three stages of submitting for arrest warrants, decision to arrest and post arrest pending detention. According to this, restriction mechanism is designed which can help to realize the integrity of arrest decision mechanism, unify the restriction requirements of procuratorate and court at various stages so as to strengthen the maneuverability of judicial application. |
