在儒家的道德框架内,容隐具有道德正当性,正当性体现在其对道德冲突的处理、人性的认识、道德顺序的认识等方面,它反映了人性的内涵,因而也具有普遍性。同时,亲亲相隐和腐败无必然联系,以废除容隐来制止腐败并不可行,当前很多国家的例子也说明了这一点。目前中国法律因缺乏容隐制度带来了一系列问题,要解决这些问题,就应综合考虑对亲属亲疏程度的区分、对行为方式的区分、容隐的例外制度等因素,以重建容隐制度。 |

Abstract: |
Concealment is of moral legitimacy within the framework of Confucian. The moral legitimacy is shown in its treatment of moral conflict, its understanding on human nature and moral order, which reflects the meaning of humanity and thus universal. Rather, there is not necessarily any connection between concealment and corruption, which is verified by the current law practice in many countries. A variety of problems have been caused due to the lack of concealment in Chinese law system. To solve these problems, we should make a reconstruction of concealment system. |
