高校毕业生就业协议书的性质争议颇大,破解症结在于厘清就业协议的主体和内容。高校作为就业协议的管理者,应被排除缔约主体的地位;通过对现行就业协议内容进行类型化区分,可认定就业协议构成劳动合同或预约合同。而以就业协议的解除进行检视,劳动合同说更具理论价值和现实意义。为此,现下就业协议需相应改革,确保在内容和规范适用方面符合劳动合同的标准。 |

Abstract: |
The nature of college graduates employment agreement is quite controversial and the dispute disintegration lies in clarifying the subject and content of the employment agreement. As the administrator of graduates employment agreement, colleges should be excluded from the subject status, by classifying the content of current employment agreement, arriving at a conclusion that employment agreement constitutes labor contract or precontract. However, by interviewing the employment agreement dissolution, labor contract has more theoretical value and practical significance. Therefore, it 's necessary to reform the current employment agreement, ensuring the content and specification applicability are in accord with the standards of labor contract. |
