大学章程视角下高校学位授予的主体权力边界厘定

摘要:
学术评价权反映了高校学位授予权的本质属性,属于高校的办学自主权。中国现行学位授予权的法律制度不完善导致学术权力被边缘化,相关主体权力行使界限模糊、权力运行规则不合理制约了高校学位授予权的有效实施。为此,需要加强大学章程建设,实现权力配置科学化、权力行使规范化、权力运行程序化,确立以教授治学为载体的学术权力在高校学位授予中的法律地位,突出学术权力的核心地位和作用,明晰学术评价权运行的程序性规则,公开学术评价的标准和内容,完善校内申诉制度,确保高校学位授予权的自主且合法运行。

Setting Power Boundaries of Degree-conferring from the Perspective of University Constitution

Abstract:
Power of academic assessment reflects the fundamental attribute of university power of degree-conferring and also is a part of autonomy in university running. Insufficient legal system supply of power of degree-conferring leads to marginalization of academic power, and the effective implementation of degree-conferring power is constrained by unreasonable power-based running rules and unclear boundaries of powers. So, it is necessary to enhance university constitution construction for the purpose of scientific power configuration, standardized exercise of power and programmed power running. Also, we should establish the legal status of professor academic power in university degree-conferring, highlight the core position and role of academic power, clear the procedural rules of running academic evaluation right,disclose the standards and contents of the academic evaluation, improve appeal system for college students, so as to ensure the autonomy and legal operation of university degree-conferring powers.
