| 政府信息公开制度旨在保障公民的知情权,促进阳光行政,但是近年来该制度在实施过程中却出现了大量滥用申请权的行为。政府信息公开制度应围绕“主权逻辑”和“治理逻辑”展开,在公民权利保障与政府治理效率中寻求平衡,但滥用申请权的行为却隐含着“主权逻辑”与“治理逻辑”的悖离,使政府信息公开制度面临巨大的困境。日本、英国等国家针对申请人滥用申请权的行为,从认定主体、认定标准和程序、法律后果等方面进行有效规制,在防止行政机关规避信息公开义务的同时,禁止公民滥用申请权。中国对滥用政府信息公开申请权行为的法律规制应从加大政府信息公开力度与明确禁止申请权滥用行为等方面进行。 |

| The Legal Regulation on Abuse of Government Information Publicity Application Right:How Foreign Practice Enlightens Our Country |

| Abstract: |
| The purpose of China 's government information publicity system is to guarantee citizens right to know, to run sunshine administration. However, in recent years, there appeared a large number of abusing application right behaviors during the process of the system implement. The government information disclosure system should develop on the basis of "sovereignty" and "governance", and seek balance between guarantee of the citizens rights and efficiency of government governance. But the behavior that abuses application right also implies deviations between "sovereignty logic" and "governance logic", bringing enormous difficulties to the government information publicity system. Japan, the UK and other countries have taken some effective measures to regulate the abuse behaviors, such as, regulating identify subject, standards, procedures and legal consequences. They try to prevent the administrative organization from evading the obligation of information disclosure, and prohibit citizens from abusing their civil right at the same time. In our country, the way to regulate the behavior of abusing application right should be built by increasing the intensity of the government information disclosure and prohibiting behaviors of abusing rights, etc. |
