| 互联网信息与通信技术发展催生了网络游戏产业的产生与繁荣。网络游戏行业近年来发展迅速,其繁荣背后是网络游戏知识产权侵权阴霾。网络游戏由游戏音乐、游戏角色、游戏背景、游戏画面和游戏代码及其文档等组成,因此网络游戏是多种材料内容形成的集合体。目前中国《著作权法》尚未明确规定网络游戏属于著作权客体,司法实务中的通常做法是将网络游戏“化整为零”进行保护。然而对于作为网络游戏内容之一的网络游戏画面的著作权保护,因其复杂性,一直未形成一致观点。网络游戏画面的作品定性模糊和认定困境,使得针对网络游戏画面的侵权现象频发。网络游戏画面具有艺术审美价值性,饱含游戏制作者的智力创造性以及可固定、可复制性,其符合著作权法意义的作品构成要件,具有可著作权性。网络游戏画面是一个集合概念,涉及不同方式形成的画面,故其具体可作为何种作品类型进行保护需要具体分析,不可作“一刀切”规定。 |

| Internet information and communication technology development has spawned the emergence and prosperity of the online game industry. Network game industry has developed rapidly in recent years, but the prosperity of the network game is behind the haze of intellectual property infringement. Online games consist of game music, game characters, game backgrounds, game pictures and game codes and their documents. Therefore, online games are a collection of various material contents. At present, China 's Copyright Law has not yet clearly defined online game belonging to the copyright object, and the practice of judicial practice is usually the network game "to zero" for protection. However, because of its complexity, no consensus point of view has been formed about the network game screen copyright protection. The copyright of the online game screen is fuzzy and the predicament is determined, so that the infringing phenomenon against the online game screen is frequent. Online game screen has artistic aesthetic value, full of the creators intellectual creativity. It can be fixed and is replicable. It has the constituent elements of copyright law works and is copyrightable. Network game screen is a collection concept, which involves different forms of the screen, so the specific type of work and protection kind depends on circumstances. |
