| 自霍布斯以来,由西方哲人打造的法学理论与市场经济发展的双重逻辑恰好耦合于现代性发育的轴心链条上,黑格尔将这一成果系统化,通过精神的反思运动将法与市场经济的同构统一在伦理实体中,由此可见,现代法与市场经济实质上是一种内生关系。虽然马克思通过政治经济学批判,揭露了现代性发育以来西方资产阶级所打造的法学体系实质是资本主义制度的自诩,但如何在当下全面深化改革的实践场域中深度觉解“社会主义市场经济在本质上是法治经济”的历史进步意义,需要我们全面运用马克思政治经济学批判的整体性方法加以发展与创新。 |

| Abstract: |
| Since Hobbes, the double logic of legal theory and market economy development carved out by Western philosophers has been coupled to the axial chain of the growth of modernity. Hegel systemizes this accomplishment and unifies the identity of the law and market economy by spiritual retrospection in ethical entity. It can be seen that there exists the endogenous relationship between modern law and market economy in reality. Even though Marx, by way of political economics critique, reveals that the legal system established by the Western bourgeoisie since the growth of modernity is actually nothing but boast by capitalist system, how to gain an in-depth understanding of the historical significance of "socialist market economy is actually legal economy" in the current arena of deepening reform requires us to use the holistic approach of Marxist political economics critique for development and innovation. |
