| 网约车平台与传统平台相比,网约车平台与驾驶员、乘客之间法律关系更加紧密,应当承担更多的责任。 网约车平台公司与驾驶员之间、平台公司与乘客之间存在法律关系,网约车平台公司在各类型交通事故中应当承担法律责任。受害人为乘客时,平台公司承担违约责任或者侵权责任。受害人为第三人时,若责任在网约私家车一方,平台公司应承担侵权赔偿责任;若责任在乘客一方,平台公司应承担相应赔偿责任。当受害人为驾驶员时,平台公司应承担工伤赔偿或按照过错程度承担相应赔偿。 |

| Abstract: |
| The number of traffic accidents about online car-hailing is increasing. It is necessary to analyze the responsibility of online private car-hailing platform. Compared with traditional platforms, it is more closely connected with drivers and passengers. By analyzing the legal relationship between the platform and the driver, the platform and the passengers, we analyze and determine the responsibility of the platform in all types of traffic accidents. When the victim is a passenger, the platform shall bear the responsibility for breaching contracts or infringing rights. When the victim is a third party, the platform company is liable for compensation if the responsibility is on the side of private car. If the liability is on the passenger side, the platform company shall bear the corresponding liability. When the victim is the driver, the platform undertakes the compensation for work-related injury or compensation according to the degree of fault. |
