| 社会组织是环保部门进行管理和开展工作的有益补充,世界各发达国家也都将社会组织作为国家环境保护体系中的重要力量。新修订的《环境保护法》对社会组织提起环境公益诉讼进行了法律上的规定,使满足相应条件的社会组织具有了合法的原告主体资格。但通过对近年来一些相关案例的分析发现,社会组织在提起环境公益诉讼时仍然存在着诉讼提起时资格限制较多、诉讼过程中资金压力较大、诉讼胜利后判决执行较难的现实问题。针对这些问题,应当进一步降低社会组织提起环境公益诉讼的资格条件、拓宽资金来源渠道、加大判决执行监督的力度,从而使社会组织能够依法顺利地提起环境公益诉讼,更好地发挥在环境保护工作中的积极作用。 |

| Abstract: |
| Social organization is a useful supplement to the management and work of the environmental protection department.Nowadays, developed countries regard social organizations as an important force in the national environmental protection system. Environmental Protection Law which is newly revised stipulates that social organizations can initiate environmental public interest litigation, which makes the social organization with the corresponding conditions have the legal qualification of the plaintiff. However, the analysis of some relevant cases of recent years shows that social organizations still have some practical problems when filing environmental public interest litigation, such as more qualification restrictions, greater financial pressure in the litigation process, and more difficult execution of judgment after the victory of litigation. Therefore, it is necessary to further reduce the conditions for social organizations to raise the qualifications of plaintiffs in environmental public interest litigation, broaden the channels for resolving financial pressures, and increase the enforcement of judgments, so that social organizations can smoothly bring environmental public interest litigations according to law and better play an active role in environmental protection work. |
