系统理论视角下的我国区域环境协同执法制度研究

摘要:
环境问题的复杂性、跨域性要求加强区域环境协同执法。系统理论对系统发展共同规律的研究可以为化解我国区域环境协同执法制度现存问题提供新思路。我国区域环境协同执法面临着环境协同执法体系整体性不高、环境协同执法系统开放性不足、环境协同执法秩序稳定性不强的问题。对此,应从系统优化、机制创新、秩序维护三条途径整体有序推进。其中,系统优化途径从执法主体沟通联系以及整体性的角度推进协同执法;机制创新途径从利益平衡和协调机制与信息共享等方面提高开放性;秩序维护途径从依法行政等方面推动协同执法秩序动态稳定性发展。

Research on the Regional Environmental Synergistic Law Enforcement System from the Perspective of System Theory

Abstract:
The complexity and trans-regionality of environmental issues require strengthening the regional environmental synergistic law enforcement. The study of common law of system development based on system theory can provide a new way to solve the existing problems of regional environmental synergistic law enforcement in China. China 's regional environmental synergistic law enforcement system is faced with the problems of low integrity of the enforcement system, insufficient openness of the enforcement institutions, and weak stability of the enforcement order. The synergistic law enforcement of regional environment should be promoted in three ways:system optimization, institutions improvement and order maintenance. Among them, the system optimization approach promotes coordinated law enforcement from the perspective of communication between law enforcement subjects and system integrity; the mechanism innovation approach improves openness from the perspective of benefit balance and coordination mechanism and information sharing; the order maintenance approach promotes dynamic stability of synergistic law enforcement from the perspective of administration according to law.
