| 环境权是随着环境状况日益恶化和环境法治发展而产生的一种新型权利。历经40年的发展,中国环境权理论研究取得了极大进步。学者们主要就环境权是否存在、环境权的学理分类、环境权的构成要素、环境权的法律保护、环境权的立法省思等主题进行了深入的探究。但既往的研究仍存在意涵模糊、研究方法单一、域外理论与实践研究失衡等不足。后续的环境权研究应当运用多元化的研究方法,着重从环境权子权利的类型化、环境权与其他权利的冲突与协调、国内外环境权理论与实践的动态衔接、基于司法逻辑的环境权确认路径等方面予以推进和深化。 |

| Abstract: |
| Environmental right is a new kind of right arising with the deterioration of environmental conditions and the development of environmental law. In the past 40 years, great progress has been made in China's environmental rights theory. Scholars have made in-depth research on the existence of environmental rights, the theoretical classification of environmental rights, the elements of environmental rights, the legal protection of environmental rights, and the legislative reflection of environmental rights. However, there are still some deficiencies in the previous research, such as vague meaning, single research method, and imbalance between foreign theoretical and practical research. The follow-up research on environmental rights should be promoted and deepened with diversified research methods, focusing on the classification of sub rights of environmental rights, the conflict and coordination between environmental rights and other rights, the dynamic convergence of theory and practice of environmental rights at home and abroad, and the confirmation path of environmental rights based on judicial logic. |
