| 2024年11月,《能源法》经全国人大常委会审议通过,标志着我国能源领域的基本法律体系建设迈出关键一步。这部基础性法律历经数十年曲折探索才最终得以出台。我国能源立法演进历程可划分为萌芽期、探索期、深化期、转型期和完善期五个阶段,显示了能源法治建设的阶段性特征与内在逻辑。“双碳”目标的驱动、能源高质量发展的现实需求以及能源安全保障的法治需要,共同推动了《能源法》的最终落地。未来能源立法完善的多维进路包括:以《能源法》为核心统摄并优化能源领域单行法体系,构建与《能源法》相配套的激励与约束机制,统筹平衡生态保护与能源安全需求以有效应对国际能源变局。由此,实现能源法律制度与“双碳”目标的深度协同,为我国能源绿色转型和高质量发展提供坚实的法治保障。 |

| China 's basic legal system construction in the energy sector has made a significant stride forward as the Energy Law of the People 's Republic of China was deliberated and adopted by the Standing Committee of the National People 's Congress in November 2024, after decades of tortuous exploration. The energy legislation in China may be said to have undergone five phases of embryogenesis, exploration, furtherance, transition, and refinement, revealing the staged nature and intrinsic logic of the country 's energy rule of law construction. The enactment of the Energy Law has been jointly propelled by the "Dual Carbon"goals, the demand for high-quality path of energy development, and the legal requirement safeguarding energy security. For the future optimization of the energy legislation, there must be a multi-dimensional approach by, for instance, further perfecting separate energy laws under the super-ordination of the Energy Law, constructing corresponding incentive and restraint mechanisms in line with the Law, and balancing ecological protection and energy security to effectively respond to changes in the international energy field, before the final realization of an in-depth synergy between the energy legal system and the "Dual Carbon" goal, providing legal safeguards for China 's green energy transformation and high-quality development. |
