| 当前行政乱作为现象趋于减少,而相对隐性的行政不作为现象有抬头之势,影响了政令畅通,造成了社会危害。行政不作为的表现形态主要有迟延履行法定职责、未全面履行法定职责、对申请不予答复或逾期答复、对行政相对人申请要求作为不到位或拒绝履行、不按约定履行行政契约或行政承诺中的行政义务等。针对存在的问题,应科学设置政府职权职责、尽快制定行政程序法典、完善对行政不作为的诉讼救济制度、完善行政执法管理制度、强化政府执法人员的依法履职意识、完善监督制度等,以期达到预防与遏制行政不作为的目的。 |

| Abstract: |
| With the declining of administrative malfunctions, the comparative implied administrative omission began to take root, both delaying the performing of the government orders and having bad effect on the society. This thesis deals with classifications of the contemporary administrative omission manifestations, i.e. delaying the fulfillment of the legal duties, no fully-fulfill the legal duties, no answering to the applications or exceeding the time limit, not properly exceeding or denying the applications of the administrative counterparts, not fulfilling the administrative contract or administrative duties accordingly. Considering the contemporary problems, the author puts forwards her own countermeasures, including a general management of the government 's rights and duties, hastening the drafting of administrative code in China, improving the litigation costs relief, perfecting the regulations of the administrative management, enforcing the administrator 's sense of duty, improving the inspection system, etc, thus achieving the goal of preventing and suppressing of the administrative omissions. |
