| 中国法院经费保障体制经历了诉讼费用“坐收坐支”和“收支两条线”确立、落实、改革四个阶段。现行法院经费保障体制已经成为制约审判职能充分发挥的重要因素,表现在法院办公、办案经费不足,法官不独立,司法权力地方化等。理论界对改革和完善法院经费保障体制主要设计了中央与省级统筹“双轨制”和完全的中央统筹两种方案。在考察与借鉴国外成功立法的基础上,结合中国的具体实践,总体实行中央与省级统筹“双轨制”,再配合各项具体制度以弥补理论界方案的不足,将省级财政作为中央与县市财政的一个“对接点”,是一种可行的方案。 |

| China 's courts funds guarantee system experienced a litigation cost "to obtain and use funds without authorization", "separation between revenue and expenditure" establishment, implementation and reform stages. The current court funds guarantee system is an important factor that judicial function can 't give full play to its role. For example, the court office and casehandling funds are insufficient, judges are not independent completely, and judicial power is localized, etc. Theoretical circles mainly design two solutions, "doubletrack system" that means the central and provincial plan as a whole and complete central plan as a whole. On the basis of experiences of other countries successful legislation, the author suggests a plan combining our country 's concrete practice. The plan is the central and provincial plan as a whole and many specific systems, which can make up the shortage of the above theoretical solution, coupled with. It 's necessary that provincial finance become a joint between central finance and city / town finance. Our aim is to build a longterm mechanism of court funds guarantee system. |
