| 审判委员会存续的正当性与必要性一直备受争议,这种争议通常聚焦于职能定位与运行机制两个方面。在职能定位方面,作为一种审判组织,司法职能是审判委员会最基本的职能,其中,审判职能——无论是“法律审”还是“事实审”都应当得到加强,审判监督职能则应当被削弱或取消。在运行机制方面,首先应当完善其组织结构,其次应当完善其运行程序——注重诉讼化改造以充分保障当事人的诉权。只有明晰审判委员会的职能定位、变革审判委员会的运行机制,其在特定案件审判、执行司法政策、保障司法独立以及维护司法公正等方面的作用才能得以充分发挥。 |

| Abstract: |
| The legitimacy and the necessity of judicial committee have been controversial as regards its functional orientation and operational mechanism. In terms of its functional orientation, a fundamental function of the judicial committee is the judicial function including "findings of factual issues" or "findings of legal issues", which should be strengthened,while its judicial supervision function should be weakened or abandoned. In terms of its operational mechanism, firstly,it is necessary to improve the structure of the judicial committee, secondly,the optimization of its operational procedures is also important. More attention should be paid to the lawsuit reform in order to fully protect parties litigious right. With an identification of its functional orientation and a reform of its operational mechanism, it is possible for the judicial committee to fully exercise its duties on judging special cases, executing judicial policies, ensuring the judicial independence and protecting the judicial justice. |
