| 哈贝马斯形式正义理论一直是学者争议的话题。就该范畴是否严格符合政治哲学的定位、它与合法性理论的关系等问题,不同研究者提出了不同理解。通过分析文本可知,哈贝马斯早期借鉴伽达默尔诠释学思想,并加入德国古典哲学的批判性,建立起了极有创造力的“批判诠释学”。以之为方法论,他进一步构造出“商谈民主”理论,形成探讨实质正义问题“理想的言语环境”。这种语境下的“正义”,既有罗尔斯所谓“程序正义”特质,又与“合法性”概念根本一致,表现出现代政治哲学“正义”思想新思维。 |

| On Hermeneutics of Habermas Understanding of Justice: with Discussion of the Relation Between Justice and Legitimacy |

| Abstract: |
| Habermas theory of formal justice leads to many discussions. Different scholars have their owe views on its nature and its relation with legitimacy. As a matter of fact, Habermas creates modern "critical hermeneutics" in which the traditional criticism is founded on the Gadamer 's hermeneutics. By means of this an ideal context for substantive justice must be constructed. Justice in such context can be conceived as a kind of ‘procedural justice’, and we can interpret justice and legitimacy in the same way. Hence we can say that Habermas determines a new criterion of justice in modern political philosophy. |
