| 在深化市场改革背景下,城镇管道燃气行业的垂直一体化管理体制呈现出诸多弊端,随着国家在公用事业领域开放政策的落地,由国营企业垄断经营城镇燃气行业的格局正逐渐被打破。但通过对福建省城镇管道燃气特许经营制度的考察发现,当前仍然存在 地方审批制度不规范、行政授权性垄断“名无实存”、监管机制不完善三类典型问题。结合福建省的问题辐射全国燃气特许经营制度,对已建立城镇管道燃气特许经营制度各省(自治区、直辖市)的地方法规规章进行梳理,进一步发现普遍存在法规规章不完善、第三方市场冲击严重、违规授权等问题。因此,明确城镇管道燃气特许经营范围与审批权限是解决上述问题的可采进路,同时应辅以价格规制与多维公众参与,以期实现市场有序、权责有据。 |

| Study on Typical Problems of Urban Gas Pipeline Franchising System:Using the Typical Problems of Fujian Province as an Example for Investigation |

| In the context of deepening market reform, the vertical integrated management system of urban pipeline gas industry presents a number of shortcomings. With the implementation of the liberalization policy in the utility sector in China, the pattern of the state-owned enterprises' monopoly of the urban gas industry is being constantly broken. However, the investigation of urban piped gas franchising system of Fujian Province shows that there are still three types of typical problems:the administrative approval system is not standard, the administrative authorization still exists in reality, the regulatory mechanism is not perfect. An investigation of the local regulations of the provinces (cities) nationwide that have established urban piped gas franchise systems shows the further problems, including widespread inadequate rules and regulations, serious third-party market impact, illegal authorization and other issues. Therefore, a clear urban piped gas franchising scope and approval authority are feasible ways to solve the problems, which should be supplemented by price regulation and multi-dimensional public participation, for achieving an orderly market with authority and responsibility. |
