| 源于私益领域的惩罚性赔偿制度,因环境公益保护需要,渐入环境民事公益领域。私益属性惩罚性赔偿侧重于损害填补和救济功能实现,公益性惩罚性赔偿更强调公益保护和惩罚威慑功能实现。现行环境民事公益诉讼惩罚性赔偿在司法实践操作中存在公益、私益不分的倾向。环境民事公益诉讼的环境公益保护目的,决定了应构建与其属性相耦合的公益惩罚性赔偿制度,在立法上赋予公益诉讼原告公益惩罚性赔偿请求权,以比例原则作为确定公益惩罚性赔偿金的标准,以保障公益效能实现作为执行公益惩罚性赔偿金的指引。 |

| Abstract: |
| Due to the needs of environmental public welfare protection, the punitive compensation system which originated from the field of private interests has gradually entered the field of environmental civil public welfare. Punitive compensation for private interests mainly focus on damage compensation and the realization of relief function, while public welfare punitive compensation emphasize the protection of public welfare and the realization of punitive and deter function. There is a tendency that punitive compensation for environmental civil public interests do not distinguish between public interests and private interests in judicial practice. The purpose of environmental public interest protection of environmental civil public interest litigation determines that a public interest punitive compensation system coupled with its attributes should be constructed, the plaintiff of public interest litigation should be given the right to claim public interest punitive compensation in legislation, the principle of proportion should be followed to determine public interest punitive compensation, and the realization of public interest efficiency should be guaranteed as the guidance for the implementation of public interest punitive compensation. |
