| 《能源法》的出台弥补了我国能源基本法的缺位,标定了我国能源领域规范体系建构的基点。《能源法》出台之后,其规范续造成为亟待完成的核心任务,是能源法律规范体系与能源非法律规范体系进一步发展完善的关键问题。 《能源法》的规范续造要立足于其基本法定位、立法目的的解析、功能的阐释及实现。《能源法》的规范续造主要有四种方式:细化《能源法》规范、填补《能源法》漏洞、在法律授权下制定具体规则、创制新规范。《能源法》规范续造应当采取双重策略:既要完善我国能源法律规范体系,也要型构我国能源非法律规范体系。当然,《能源法》的规范续造是一个长期的过程,藉由设想未来能源系统和社会的“技术形态”和“伦理形态”,建构我国自主的能源系统与能源社会。 |

| Abstract: |
| The promulgation of the Energy Law has filled the gap in China 's basic energy legislation and laid the foundation for the construction of a normative system in the energy sector. After its promulgation, the rechtsfortbildung or ensuing supplementation becomes an urgent core task, pivotal to the further development and optimization of the energy legal and non-legal norm systems in the energy field. The rechtsfortbildung should be conducted in compliance with the basic positioning of the Energy Law, and through its legislative purpose analysis, and function explication and realization. There may be four ways for rechtsfortbildung:refining the norms of the Energy Law, filling its gaps, formulating specific rules under legal authorization, and creating new norms. A dual strategy should be adopted for this process:both improving China 's legal norm system for energy and shaping China 's non-legal energy norm system. As a long-term process, the rechtsfortbildung must be made by envisioning the "technological form" and "ethical form" of the future energy system and society to build an independent energy system and energy society in China. |
