| 推进能源法治建设,既是中国式现代化的应有之义和本质要求,也是实现中国式现代化的有力保障。我国能源法规范制定之初就表现出明显的实践属性与现实目的性,不可避免地造成了能源法形式理性与实质理性的张力和矛盾。首先,从能源法规范的理性基础研究出发,理顺能源法规范体系形式化品格和规范性需求的基础逻辑；在把握系统论的基础上,有效识别能源法规范体系的核心内容及规范边界,明确能源法规范体系兼顾宪法秩序与部门法理的价值定位。继而,从规范承载、逻辑耦合、理性演进层面推演我国能源法规范体系,实现能源理性的表达以及能源法律规则的自控,并强调能源法规范体系贯融性的结构内容,通过体系构造来固定规范性期待,完成控制型和促进型相结合的制度法律化,以期达致“形神兼备”的能源法规范目标,更好地服务于中国式现代化建设。 |

| The Rational Basis and System Construction of Energy Law Norms in China |

| Promoting the construction of energy-related rule of law is not only an inherent requirement and essential feature of Chinese-style modernization but also a strong guarantee for its realization. Since the inception of energy law norms in China, they have demonstrated distinct practical attributes and real-world objectives, inevitably giving rise to tensions and contradictions between the formal and substantive rationality of energy law. This paper commences with a study of the rational foundation of energy law, aiming to clarify the fundamental logic underlying the formal characteristics and normative requirements of energy law norms. Based on an understanding of systems theory, it effectively identifies the core content and normative boundaries of the energy law norm system, and clarifies the positioning of the energy law norm system that balances the constitutional order and departmental legal theory. Subsequently, the normative system of China 's energy law is deduced from the perspectives of normative bearing, logical coupling, and rational evolution. This is intended to achieve the expression of energy-related rationality and the self-regulation of energy legal rules. Additionally, it emphasizes the coherent structural content of the energy law norm system. By improving the energy law norms at the level of system construction, normative expectations are solidified, and the legalization of a system that combines control-oriented and promotion-oriented mechanisms is completed. The ultimate goal is to achieve the "unity of form and essence" in energy law norms, thereby better serving the construction of Chinese-style modernization. |
