| 金融是推动生态环境保护的重要制度工具,亦为《生态环境法典》所确认。审视《生态环境法典》金融条款,存在金融支持领域范围不周延、金融支持工具类型不完备、金融监管体系 设计不明晰及金融国际合作指引不够有力等结构性问题。实现《生态环境法典》金融条款从规范宣示向制度落地的有效转化,须恪守一体化保护和系统治理、包容与审慎相容以及借鉴与创新相结合等原则。在此基础上,综合运用体系解释与目的解释方法,科学阐释《生态环境法典》金融条款中的模糊性规则,创新支持金融条款实施的政策指引,构建跨部门协同实施机制,方可形成实施路径清晰、风险防控有效、契合生态环境治理客观规律的金融规范体系,真正释放金融促进绿色低碳发展的制度效能。 |

| Abstract: |
| Finance constitutes an important institutional instrument for promoting ecological and environmental protection and has also been recognized by the Ecological and Environmental Code. An examination of the financial provisions of the Code reveals several structural deficiencies, including an incomplete scope of financial support, insufficient diversity of financial instruments, unclear institutional arrangements for a systematic financial regulatory framework, and the lack of substantive guidance in provisions concerning international financial cooperation. To effectively transform the financial provisions of the Code from declaratory norms into operational institutional arrangements, it is necessary to adhere to the principles of integrated protection and systematic governance, compatibility between inclusiveness and prudence, and combination of comparative leaning with innovation. On this basis, a sound financial regulatory framework for ecological and environmental governance can be established by systematically and purposively interpreting the financial provisions, clarifying the ambiguous rules, formulating innovative policy guidelines to facilitate their implementation, and establishing cross-departmental coordination mechanisms. Such a framework is to provide clear implementation pathways, effective risk prevention and control mechanisms, and institutional arrangements consistent with the inherent logic of ecological and environmental governance, thereby fully unleashing the institutional potential of finance in promoting green and low-carbon development. |
