《生态环境法典》视域下数字生态文明建设的制度路径

摘要:
《生态环境法典》颁行之际,数字技术正深度嵌入生态环境治理,二者却遵循不同逻辑运行。法典以实体环境要素管控为中心,数字治理以数据要素为驱动,这一结构性错位在时间、范式与功能层面累积为三重制度障碍:环境数据的法律属性与权利配置悬而未决,算法辅助决策的效力、问责与透明规则付之阙如,数字平台的类型化、协同与监管框架尚未成形。究其根源,法典确立的原则性约束尚未就数字技术落实为具体制度,这并非立法疏漏,而是适度法典化的有意取舍。化解之道不在于频繁修典或另立专法,而应在法典框架内渐进续造,以环境数据制度体系化、算法治理程序化、平台治理规范化为基本路径,辅以“数绿融合”的整体保障机制,使数字生态文明法治化从工具叠加走向制度融贯。

Abstract:
The promulgation of the Ecological and Environmental Code and the deep embedding of digital technologies in environmental governance have proceeded in tandem, yet the two follow divergent institutional logics. The Code centers on the control of physical environmental elements, whereas digital governance is driven by data. Consequently, this dislocation has accumulated into three institutional obstacles in terms of temporal adaptation, governance paradigms, and functional coordination. Specifically, the legal status and rights allocation of environmental data remain unsettled; the validity, accountability, and transparency of algorithmic decision-making lack established rules; and the frameworks for typological regulation, cross-domain coordination, and oversight of digital platforms have yet to take shape. This paper argues that the underlying cause lies in the fact that the principle-based constraints established by the Code have not yet been translated into concrete institutional arrangements for digital technologies, which reflects a deliberate choice of moderate codification rather than a legislative omission. Therefore the remedy lies neither in frequent amendments to the Code nor in enactment of a separate specialized legislation, but in an incremental institutional evolution within the Code 's framework, systematizing environmental data rules, proceduralizing algorithmic governance, and standardizing platform regulation. These efforts should be reinforced by a comprehensive safeguarding mechanism of "digital-green integration" to promote the rule of law for digital ecological civilization shifting from instrumental accumulation toward institutional coherence.
