新型能源体系“清洁低碳安全高效”的法治保障研究——基于《生态环境法典》与《能源法》的关系视角

摘要:
《生态环境法典》与《能源法》共同构成了新型能源体系建设的核心法律依据。两法在清洁、低碳、安全、高效四个维度上呈现功能互补的关系:《能源法》侧重于能源产业促进与供应安全,《生态环境法典》强调能源活动的生态约束与碳排放双控。然而,两法在并行适用中面临宏观层面的立法简单平移、政策性条款过多,以及微观层面的衔接障碍:清洁维度上核电绿色身份认定与市场准入的制度断裂,低碳维度上碳市场与能源市场的规则缺位,安全维度上“有序退出”与“兜底保障”的原则抵触,高效维度上评价标准与衔接机制的不统一。破解上述困境,应遵循分领域的“法典定原则、能源法定规则”的协同机制:通过明确核电清洁身份并扩展绿证范围实现清洁价值的衔接,通过建立碳市场与能源市场的互认规则实现低碳价值的协同,通过量化协调规则调和安全价值的原则抵触,通过统一评价标准与引致条款实现高效价值的制度对接,从而实现两法从并行适用到协同适用,为新型能源体系建设提供系统完备的法治保障。

Abstract:
The Ecological and Environmental Code and the Energy Law jointly constitute the core legal foundations for the development of a new energy system. The two laws exhibit a functionally complementary relationship across the four dimensions of cleanliness, low-carbonization, security, and efficiency. The Energy Law primarily focuses on promoting the energy industry and ensuring energy supply security, whereas the Ecological and Environmental Code emphasizes ecological constraints and the dual control of carbon emission reduction in energy activities. However, the parallel application of the two laws faces challenges at both the macro and micro levels. At the macro level, the challenges include the simple transplantation of existing legislative provisions and an excessive incorporation of policy-oriented provisions; at the micro level, coordination obstacles arise in aspects as follows:in the dimension of cleanliness, institutional fragmentation persists regarding the recognition of nuclear power as a green energy source and its access to relevant markets; in the low-carbon dimension, regulatory mechanisms linking carbon markets and energy markets remain underdeveloped; in the security dimension, tensions exist between the principles of orderly phase-out and security-of-supply guarantees; and in the efficiency dimension, inconsistencies remain in evaluation criteria and coordination mechanisms. To address these challenges, a coordinated mechanism under which The Code establishes guiding principles and the Energy Law lays down operational rules should be adopted. Specifically, the clean-energy dimension can be strengthened by clarifying the status of nuclear power as a clean energy source and extending the scope of green certificate system; low-carbon objectives can be advanced through mutual recognition rules between the carbon and the energy markets; conflicts concerning energy security can be reconciled through quantified coordination rules, and efficiency goals can be promoted through the harmonization of evaluation standards and the incorporation of cross-referencing provisions. Through these measures, the relationship between the two laws can evolve from coexistence to coordination, thereby providing a systematic and comprehensive legal guarantee framework for the construction of the new energy system.
